Frequently Asked Questions

Do I need a lawyer to register a fashion trademark?

While it's not legally required, having an attorney ensures your application is complete and strategically protected.

What kind of contracts should fashion designers have?

Licensing, manufacturing, influencer agreements, and NDAs are among the most important contracts to have reviewed by a lawyer.

What should a model check before signing with an agency?

Key areas include exclusivity scope, commission structure, contract duration, auto-renewal clauses, and whether the agreement complies with applicable state law. A lawyer can identify terms that may limit your options or expose you to liability.

Can a brand use my photo without my permission?

Generally no. Using a model's image for commercial purposes without consent may violate the right of publicity and other applicable laws. The specific protections available depend on the state where you are domiciled and where the use occurred.

What is fashion modeling law?

Fashion modeling law covers the legal issues specific to the modeling industry, including agency agreements, model releases, image rights, compensation disputes, Coogan Law compliance for minor models, and the emerging area of AI-generated likeness use.
